BOOKING CONDITIONS OF CHATEAU VARY TRAVEL LTD.

We act as agents for the services we offer on the travel services pages.  Apart from the companies own property namely “Chateau Vary” and “ Vendee Villas”.  We are not agents for other owners/managers of properties that appear in the brochure or website www.chateauvary.com.  Your contract is firstly with the transporter and travel service you buy, and secondly with the owner of the property that you rent.

A booking can be make by telephone or in writing. This must be booked in conjunction with accommodation through Chateau Vary Travel Ltd. or one of our partners.

 Once the appropriate payment has been received we will, subject to availability, confirm in writing on behalf of the service providers, which completes a contract between you and the service providers.  Check this written confirmation and ensure the information is correct. We do not accept responsibility for the consequences if errors/omissions are not reported within 48 hours.

Full payment must be complete 2 months before departure.  Before this time a minimum deposit of £100.00 secures the booking.  This deposit is non-refundable.  We reserve the right to cancel any travel service we provide if payments are delayed.  Credit cards are subject to the following charges: All credit cards 2%. Switch/debit cards no surcharge.

May change due to the service providers right to alter any of the above.  We as agents reserve the right to pass these changes onto you at the cost incurred.  All details regarding prices and availability will be confirmed at the time of booking.  Should the service provider make any changes after booking the changes will be passed onto you the customer.  We are not responsible for action of this nature taken by service providers after booking has been confirmed.

We are dependent on the transports for the issue of tickets.  These cannot always be guaranteed before departure and may need to be issued at the point of departure by the transporting company.  While we will supply a reference number we are not responsible for the actual issue of these tickets and again the contract is between you and the carrier in question.

When hotel vouchers have been issued to the customer we no longer hold responsibility for these, no refund can be given for loss of vouchers or failure to check in to the designated hotel.

Results in the following charges.  More that 2 months before departure  - deposit.  Less that 2 months before departure 100% of the total cost

We Offer insurance at competitive rates to safeguard against cancellation.  We strongly advise this is purchased.

Any ticket changes that you should wish to make after the deposit has been paid will be charged at £15.  These charges are applied by Chateau Vary Travel Ltd. We cannot guarantee we will be able to meet all requests as this rests in the hands of the providers.

All return fares other than standard returns, require you to return to the UK within a specified period of time.  If you stay abroad longer, or misuse the terms of the ticket or any promotion, each crossing will revert to the published full single fare.  Any additional charges are payable at the ports before return travel.

We reserve the right to cancel the booking where the passengers do not check in for their outward ferry crossing.

Please note that we reserve the right to cancel any booking that has not been made with registered accommodation

TERMS AND BOOKING CONDITIONS FOR ACCOMMODATION AT CHATEAU VARY & VENDEE VILLAS

The Property collectively known as Château Vary and our villas in the Vendee, are offered for rental by Paul and Benedicte Goodwin ('The Owners') to the renter ('The Client) under the following conditions. (All other properties advertised in this brochure and on the website www.chateauvary.com are not the responsibility of Paul and Benedicte Goodwin. Direct payment should be made to these accommodation providers, the payment of which signifies a contract between two parties not associated with Paul and Benedicte Goodwin)

PRICES

All prices quoted are per house per week. At the Vendee Villas Calor Gas is used for hot water and cooking, and one full bottle is included in the rental. A Cleaning and Breakage deposit of £100 is required, and should be paid with the final balance. There are no other hidden charges levied by the Owners.

PAYMENTS

Reservations made by phone, fax or email will be held for 7 working days. A contract only comes into existence when we have received a deposit in the form of a stamped paying-in slip or Cheque together with a signed Reservation Form and we have issued a written confirmation of booking. The outstanding balance must be paid eight (8) weeks before the start of your holiday. If your holiday falls within this 8 week period, payment must be made in full. If payment is not received on the due date, the owners reserve the right to treat the booking as cancelled by you and the dates will be offered to other interested parties. All deposits are non- refundable. We strongly advise you to take out adequate insurance to cover any loss or damage you may incur. We offer holiday insurance at competitive rates

CANCELLATION BY YOU

Will result in the loss of the deposit. If we receive notice of cancellation less than eight weeks before your holiday start date, you will be charged the full amount due. We strongly advise you to take out adequate insurance to cover this eventuality. Please inform us immediately by telephone and confirm your cancellation in writing. If after we have issued a Booking Confirmation, you wish to alter your booking, please let us know immediately. We will endeavor to accommodate you, but this may not be possible. This service may incur extra charges.

CANCELLATION BY US

In the unlikely event that we have to cancel your booking or there are major changes to it due to matters beyond our control which are not covered below, we will advise you as soon as possible and will endeavor to offer you suitable alternative accommodation. If this is not possible or you do not wish to accept the alternatives offered, we would give you a complete refund of all monies paid by you.

ARRIVAL AND DEPARTURE

The property will be available to you from 4pm on the day of your arrival until 10am on the day of your departure. Changeover days are on Saturday unless stated otherwise. If you are unable to arrive at a reasonable time or wish to leave before 6am, please notify the owners beforehand. If you arrive at an unreasonable hour without notification and are unable to gain access to the property, we cannot be held responsible for any costs incurred for alternative overnight accommodation. All the properties are cleaned before letting, however you are responsible for keeping and leaving the property in a clean and tidy condition. There is a form relating to cleaning and inventory of the accommodation to be completed within 24 hours of arrival.

PETS If you would like to bring a pet this must be discussed and agreed beforehand.

DAMAGE AND BREAKAGE DEPOSITS

Should you or other members of your party or guests cause any damage to the property, its contents, grounds, or any third party then you will be deemed responsible for such damage. We strongly advise you to take out insurance to cover such an eventuality. Should you find any of the amenities listed in the property description damaged or broken, please bring it to the Owners attention immediately to avoid any later repercussions. A breakage deposit of £100 or 153 Euros is required. This is to be held by the owners until you have completed your holiday. Deposits are the property of the Owners and will be returned within 7 days of your departure, less any deductions for breakage’s if applicable. This can be paid in the form of a cheque or credit card details completed on the attached booking form.

Clients are responsible at all times for the safety and behavior of their children.

FORCE MAJEUR

We cannot accept liability in any circumstances where performance of the contract is prevented by reason of: War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action or any similar events outside our control.

COMPLAINTS

If a problem arises, please notify the owners immediately. No complaint will be entertained unless it is raised with the Owners personally before the property is vacated and confirmed in writing within 7 days of the end of your holiday. We reserve the right to terminate a booking at any time if any of these conditions are not met in full and you will be asked to leave the property. Please check all details of your booking confirmation carefully. A signed booking form is taken as proof that you have read understood and agree with the above Terms and Conditions and will abide by them. Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owner for the rental period. English Law shall govern this contract in all its aspects.

Advertising Terms & Conditions

1. The advertiser is wholly responsible for the accuracy of the property information published on the site.
2. Chateau Vary Travel Ltd reserves the right to modify the property information, to remove offensive or inappropriate material or to bring the information in line with the holidaylets.net house style.
3. Customer service is of paramount importance to Chateau Vary Travel Ltd and therefore, it is a requirement that advertisers should respond promptly and courteously to all enquiries.
4. Chateau Vary Travel Ltd accepts no legal responsibility for the accuracy of information, or for any action brought against the advertiser for breach of contract by the person or people renting the holiday property. Chateau Vary Travel Ltd shall not be liable to the advertiser or owner for any loss, costs or damages resulting from the use of the site, or the inability to access or use the site.
5. Advertisers are strongly advised to have a legal contract between themselves and their tenants. Chateau Vary Travel Ltd cannot be held liable for cancellations, non payment of rent, damage to the property or any other material loss.
6. When the advertiser submits a property to Chateauvary.com, the advertiser acknowledges that the material (text , graphics and photos) has not been copied or is in breach of copyright. Chateau Vary .com cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertiser.
7. The advertiser assigns Chateau Vary Travel Ltd a licence to reproduce in part, or in whole the material supplied.
8. Chateau Vary Travel Ltd reserves the right to refuse web addresses or hypertext links to other web sites from within the Chateauvary.com site.
9. Photos can be accepted by post, but it is preferable for them to be scanned and supplied by email.
10. Chateau Vary Travel Ltd reserves the right to refuse any property advertisement and cannot be held liable for any expense or loss as a result of doing so.
11. Should an advertiser request a property be removed from the site at any time, this should be done via email or in writing.
